Filing 7 PAPERLESS ORDER. Defendants allege that this Court has jurisdiction over this case based on diversity. Defendants' allegations, however, fail to plead diversity. Defendants allege that Defendant Velocity Risk Underwriters, LLC ("VRU") is a "limited liability corporation." Defendants allege that Defendant Velocity Claims is both a "limited liability company" and a "limited liability corporation." For both VRU and Velocity Claims, Defendants allege the location of those Defendants' state of incorporation and principal place of business. It is unclear, however, whether Defendants Velocity Claims and VRU are corporations or limited liability companies. If they are corporations, the allegations pled would suffice to show diversity. See 28 U.S.C. 1332 (c)(1). If, however, Defendants Velocity Claims and VRU are limited liability companies, Defendants would need to prove the citizenships of all the members of the limited liability companies. Rolling Greens MHP, L.P. v. Comcast SCH Holdings L.L.C, 374 F.3d 1020, 1022 (11th Cir. 2004). Without clarity on the form of Defendants Velocity Claims and VRU's corporate entities, the Court cannot determine whether the allegations contained in the Notice of Removal are sufficient to plead diversity. Accordingly, Defendant shall file an amended notice of removal by February 28, 2019, curing all deficiencies in the diversity allegations, or alternatively file a notice of dismissal by that date.
