Filing 9 NOTICE of Voluntary Dismissal with Prejudice by PAUL MARTINKA (Higbee, Melissa) |
Filing 8 PAPERLESS ORDER REQUIRING FILING OF CLOSING DOCUMENTS AND EXTENDING DEADLINE FOR DEFENDANT TO RESPOND TO THE COMPLAINT. The Parties have filed a Joint Notice informing the Court that they have reached a settlement (DE #7 ). The Court congratulates the Parties on their amicable resolution of this matter. The Notice requests that the Parties be given 30 days to finalize their settlement agreement, however no basis for such a lengthy delay is explained. Therefore I will require appropriate closing documents to be filed 10 days from the filing of the Notice of Settlement, which is on or by November 25, 2019. The Parties are advised that the Court will retain jurisdiction to enforce their settlement agreement if requested to do so at the time of closing. The Parties are further advised that the Notice of Settlement does not operate as a stay of this litigation. Therefore, until a voluntary dismissal is filed, the Parties must comply with all litigation deadlines. However, in light of the pending settlement, I will extend the deadline for Defendant to file an Answer to the Complaint. Defendant must respond to the Complaint on or by November 25, 2019. Signed by Judge Donald M. Middlebrooks on 11/19/2019. (kal) |
