May 18, 2020 Opinion or Order Filing 17 PAPERLESS ORDER. Plaintiff filed a Return of Service Affidavit indicating that Defendant was served on April 13, 2020, making the deadline for it to respond to the Complaint May 4, 2020. (DE #13 ). Defendant did not respond by the deadline. Accordingly, if Plaintiff intends to seek final default judgment in this matter, Plaintiff must file a Motion for Clerk's Entry of Default against Defendant on or by May 22, 2020. Any subsequent Motion for Final Default Judgment against Defendant must be made by Plaintiff within ten (10) days after Clerk's entry of default. Pursuant to S.D. Fla. Local Rule 7.1(a)(2), motions for default judgment must be "accompanied by a proposed order that is filed and submitted via e-mail to the Court as prescribed by Section 3I(6) of the CM/ECF Administrative Procedures." Thus, in conjunction with filing any Motion for Final Default Judgment, Plaintiff must send a proposed order in Word format to the Court's e-mail in accordance with Local Rule 7.1(a)(2). Plaintiff's proposed order granting final default judgment must contain legal analysis as to the claims on which Plaintiff is seeking default and how the facts pled, taken as true, justify awarding Plaintiff default judgment. April 15, 2020 Opinion or Order Filing 8 PAPERLESS ORDER striking #7 Agreed Notice of Dismissal of Count I of Complaint and Dismissal of Relief Defendant, Comerica Bank. In the present Notice, Plaintiff seeks to voluntarily dismiss Count I of its Complaint as to all Defendants. However, while Federal Rule of Civil Procedure 41 allows a plaintiff to dismiss all claims against a particular defendant, "its text does not permit plaintiffs to pick and choose, dismissing only particular claims within an action." Klay v. United Healthgroup, Inc., 376 F.3d 1092, 1106 (11th Cir. 2004). "'A plaintiff wishing to eliminate particular claims or issues from the action should amend the complaint under Rule 15(a) rather than dismiss under Rule 41(a).'" Id. (quoting 8 Moores Federal Practice 41.21 2 , at 4132).
