Date Filed Document Text
July 31, 2020 Opinion or Order Filing 9 PAPERLESS ORDER. On July 30, 2020, the Parties notified the Court that they have settled this matter. (DE #8 ). I congratulate the Parties on reaching an amicable resolution of this case. Under the ADA Title III Scheduling Order's instructions (DE #4 at 3), closing documents are to be submitted within ten (10) days of notification of settlement. Accordingly, the Parties are directed to file the appropriate closing documents by August 10, 2020. The Court will retain jurisdiction to enforce the terms of the Parties' settlement agreement if requested to do so before closing the case. The Parties are advised that the Notice of Settlement does not stay this litigation, and therefore until a joint stipulation of dismissal is filed, the Court will expect compliance with all pretrial deadlines. However, I will grant a limited ten-day extension for Defendant to file its response to Plaintiff's Complaint and its corporate disclosure statement. Because these deadlines have now been extended twice, I am not inclined to extend them any further. Therefore, on or before August 10, 2020, the Parties shall file the appropriate closing documents or Defendant shall file a response to the Complaint and its corporate disclosure statement. Signed by Judge Donald M. Middlebrooks on 7/31/2020. (jdr)
July 30, 2020 Filing 8 NOTICE of Settlement by WELLS FARGO BANK, N.A. (Storper Joseph, Beth)
July 16, 2020 Opinion or Order Filing 7 PAPERLESS ORDER granting in part #6 Defendant's Unopposed Motion for Extension of Time. Defendant's response to Plaintiff's Complaint is currently due by July 17, 2020. In the present Motion Defendant requests that this deadline as well as the deadline to file its corporate disclosure statement be extended until August 7, 2020. (DE #6 ). Defendant makes this request because "counsel was just recently retained and is currently investigating Plaintiff's allegations and gathering the necessary information to properly respond to Plaintiff's Complaint and to file" the corporate disclosure statements. (DE #6 at 1). Under these circumstances, I find good cause to enter a limited extension. Defendant's deadlines to respond to the Complaint and to file the corporate disclosure statement are extended until July 31, 2020. Signed by Judge Donald M. Middlebrooks on 7/16/2020. (jdr)
