September 4, 2020 Opinion or Order Filing 10 PAPERLESS ORDER EXTENDING DEADLINE. On September 3, 2020, I issued an Order Granting Leave to Amend Complaint, noting deficiencies in Plaintiff's complaint and directing Plaintiff to file an Amended Complaint (or a notice of voluntary dismissal) by September 9, 2020. (DE #6 ). On September 4, 2020, Plaintiff filed a document (DE #9 ) which is untitled, and which is addressed to "The Honorable of Justice [sic] of Set Court," which I presume is directed to me. The document goes on to state: "I enclose this letter as a request to attend [sic] the time for me answering your requirement to amend the Complaint" and asks for two additional days due to the upcoming holiday weekend. I will construe this document as a motion for extension of time and grant it. Accordingly, the deadline for Plaintiff to file an Amended Complaint (or notice of dismissal) is extended from September 9, 2020, to September 11, 2020. However, I must caution Plaintiff to ensure that future filings with this Court comply with Federal Rule of Civil Procedure 7, which provides that "[a] request for a court order must be made by motion" and must "state with particularity the grounds for seeking the order," among other requirements. Counsel is also directed to ensure that all future filings with this Court comply with the Local Rules of the Southern District of Florida, specifically Rule 7.1., governing the filing of motions. I note that Plaintiff's request for extension of time to file an amended complaint also contains information concerning Plaintiff's efforts to serve Defendant and includes attachments pertaining to service of process, including what appears to be a revised or amended summons. However Plaintiff does not appear to be requesting any action by the court in this regard, and therefore Plaintiff's intentions are unclear with respect to why this information is included in the request for an extension of time. Plaintiff's ongoing efforts to effectuate service must comply with Rule 4 of the Federal Rules of Civil Procedure, and any issues pertaining to service will be addressed by this court if submitted by way of an appropriate motion.
