The Motion concerns Defendants' depositions, presently noticed for June 7-8, 2021, in West Palm Beach, Florida. According to the Motion, defense counsel has requested that the deposition notices "be withdrawn and a singular deposition notice be reissued to Mr. Bluman so he may sit, via Zoom, for a singular seven (7) hour deposition." As grounds, Defendants cite various significant CV-19 related safety concerns with requiring Mr. Bluman and his counsel to travel next month to appear for an in-person deposition. In addition, Defendants argue that requiring Mr. Bluman to be deposed twice on behalf of himself individually and again on behalf of his solely-owned Defendant entity would be unreasonably cumulative and duplicative. According to the Motion, Plaintiffs are opposed to the relief sought. The Motion is due to be denied without prejudice for failure to comply with the procedures set forth in the Court's Order Setting Discovery Procedure #27 -including but not limited to a renewed good faith conferral of counsel followed by a request for hearing if necessary. These procedures are designed to promote an efficient and orderly resolution of genuine discovery disputes requiring Court intervention. In addition, a cursory review of the Motion suggests that a renewed good faith conferral on the issues raised is likely to yield narrowing of the disputed issues or obviate the need for Court intervention altogether. Counsel shall bear in mind that this Court, along with many others in this District, have routinely approved of depositions being held remotely in these times of CV-19 out of concern for the safety of all parties involved. To the extent counsel are able to agree to conduct Mr. Bluman's deposition via Zoom or other similar remote video conference platform, the Court encourages counsel to consider reviewing the useful parameters set by U.S. Magistrate Judge Maynard in Townhouse Restaurant of Oviedo, Inc. v. NUCO2, LLC, 2020 WL 3316021 (S.D. Fla. May 5, 2020). Regarding the request for a limitation on the total deposition time, the Court has faith that counsel will be able to reach a reasonable agreement on this issue especially if they are able to agree to proceed via Zoom which should provide added flexibility.
