Date Filed Document Text
December 31, 2020 Filing 15 Joint SCHEDULING REPORT - Rule 26(f) by Janet Prince (Fornaro, Matthew)
December 23, 2020 Opinion or Order Filing 14 PAPERLESS ORDER granting #11 Defendant Equifax Information Services, LLC's ("Equifax") Unopposed Motion for Extension of Time. The deadline for Equifax to respond to the Complaint (DE #1 ) is December 23, 2020. (DE #4 ). Equifax seeks an extension until January 8, 2021, citing that it "endeavors to resolve cases through early settlement when possible[,]" but that "[i]n light of the COVID-19 pandemic and office closings (along with the upcoming holidays), it takes longer for Equifax to obtain and review [the] documents and begin settlement negotiations." (DE #11 at 1-2). In light of the potential settlement discussions and the fact that the relief is unopposed, I find good cause to grant the Motion. Therefore, the deadline for Equifax to respond to the Complaint (DE #1 ) is extended from December 23, 2020, to January 8, 2021. No other litigation deadlines are modified or amended as a result of this Order. However, I caution Equifax that should the Parties fail to amicably resolve this matter as hoped, that fact alone shall not constitute good cause to further extend this filing deadline. Thus, if no notice of settlement is filed before January 8, 2021, then Equifax shall timely respond to the Complaint by that date, as I am not inclined to grant any further extensions of this deadline. (Answer due 1/8/2021) Signed by Judge Donald M. Middlebrooks on 12/23/2020. (kal)

December 18, 2020 Opinion or Order Filing 9 PAPERLESS ORDER granting in part #8 Defendant Wells Fargo Bank, N.A.'s ("Wells Fargo") Unopposed Motion for Extension of Time. The deadline for Wells Fargo to respond to the Complaint (DE #1 ) is December 28, 2020. (DE #5 ). Wells Fargo seeks an extension until January 18, 2021, citing a need to "continue and complete its investigation... and develop its factual and legal defenses" and that Wells Fargo "anticipates a delay in obtaining and reviewing the necessary documents and information during the holiday season." (DE #8 at 2). Motions to extend litigation deadlines must set forth good cause supported by specific facts. Wells Fargo's Motion is supported by conclusory and speculative assertions which do not provide the Court with any basis upon which to evaluate whether good cause exists to grant the requested relief. Nevertheless, I note that the extension is unopposed, and therefore I will grant the Motion in part. Accordingly, the deadline for Wells Fargo to respond to the Complaint is extended from December 28, 2020, to January 4, 2021. Future requests for extensions will be denied unless the moving party can establish that a particular deadline cannot be met despite diligent efforts. (Answer due 1/4/2021). Signed by Judge Donald M. Middlebrooks on 12/18/2020. (kal)
