January 22, 2021 Opinion or Order Filing 12 PAPERLESS ORDER GRANTING IN PART #11 Joint Motion for Extension of Time. The deadline for Plaintiff to file a notice of voluntary dismissal is January 22, 2021. (DE 10 ). The Parties seek a 10-day extension, citing "the unavailability of Defendant's representatives to approve the settlement agreement between the parties." (DE #11 ). Although the Parties' articulated basis for this extension is conclusory, I will nevertheless grant the relief in part. The deadline for Plaintiff to file a notice of voluntary dismissal is extended to January 29, 2021. In light of the pending settlement, I will extend the deadline for Plaintiff to provide Defendant with a copy of a written report concerning any claimed ADA violations to January 29, 2021. No other litigation deadlines are modified or amended as a result of this Order. Until the notice of dismissal is filed the Parties shall abide by the litigation schedule. January 13, 2021 Opinion or Order Filing 10 PAPERLESS ORDER SETTING DEADLINE FOR FILING CLOSING DOCUMENTS. Plaintiff has filed a Notice of Settlement (DE #9 ), and the Court congratulates the Parties on their amicable resolution of this matter. Plaintiff's request for 10 days to file closing documents is granted. Moreover, because Defendant has not yet served "either an answer or a motion for summary judgment," the Parties need not file a joint stipulation of dismissal, as Plaintiff suggests. Fed. R. Civ. P. 41(a)(1)(A)(i). Rather, a notice of voluntary dismissal shall be sufficient to dismiss this case. Plaintiff is therefore directed to file a notice of voluntary dismissal on or before January 22, 2021. Until closing documents are filed, the Court expects compliance with all litigation deadlines. Additionally, the Parties are advised that they may move for the Court to retain jurisdiction upon closing the case if necessary to enforce the terms of their settlement agreement.
