February 16, 2021 Opinion or Order Filing 8 PAPERLESS ORDER SETTING DEADLINE FOR FILING CLOSING DOCUMENTS AND EXTENDING DEADLINE TO RESPOND TO COMPLAINT. Plaintiff has filed a Notice of Settlement (DE #7 ), and the Court congratulates the Parties on their amicable resolution of this matter. Plaintiff's request for 10 days to file closing documents is granted. Because Defendant has not yet served "either an answer or a motion for summary judgment," the Parties need not file a joint stipulation of dismissal, as Plaintiff suggests. Fed. R. Civ. P. 41(a)(1)(A)(i). Rather, a notice of voluntary dismissal shall be sufficient to dismiss this case. Plaintiff is therefore directed to file a notice of voluntary dismissal on or before February 22, 2021. Plaintiff's request that the Parties "not be required to file any further responses, motions, and/or pleadings" is denied, as the Court does not view the filing of a Notice of Settlement as a basis to stay the litigation. Until closing documents are filed, the Court expects compliance with all litigation deadlines. However, in light of the pending settlement, I will extend the deadline for Defendant to respond to the Complaint to February 22, 2021. Additionally, the Parties are advised that they may move for the Court to retain jurisdiction upon closing the case if necessary to enforce the terms of their settlement agreement.
