PAPERLESS ORDER denying without prejudice #12 Joint Motion to Continue Trial. The trial in this matter is currently set for the two-week trial period commencing January 3, 2022. (DE #9 ). The Parties seek to extend several pretrial deadlines and to continue trial until October 2022, citing the anticipated volume of discovery and suggesting that this case is appropriate for disposition on a "Standard Track." (DE #12 ). The Scheduling Order may be modified only upon a showing of "good cause." Fed. R. Civ. P. 16(b)(4). "This good cause standard precludes modification unless the schedule cannot 'be met despite the diligence of the party seeking the extension.'" Sosa v. Airprint Sys., Inc., 133 F.3d 1417, 1418 (11th Cir. 1998) (citing Fed. R. Civ. P. 16 advisory committee's note). The Parties' Motion is premature given that discovery is not set to close until October 2021 and trial is currently scheduled nearly eight months out. For the time being, the Parties should diligently attempt to comply with the Pretrial Scheduling Order. Further, the Parties are advised that I do not generally adhere to the case management tracks set forth in the Local Rules. However, at any time, they may consent to the jurisdiction of United States Magistrate Judge Dave Lee Brannon, who generally allows litigants great flexibility in setting the course of their case, including the discovery schedule and trial date.
