PAPERLESS ORDER granting #13 Plaintiff's Motion for Leave to File Verified Second Amended Complaint. Plaintiff seeks leave to file a Second Amended Complaint in order to omit the fictitious Defendants in light of my Order to Show Cause directing Plaintiff to cite legal authority and set forth a cogent argument as to why the Amended Complaint's jurisdictional allegations as to those Defendants should be sufficient to establish that jurisdiction exists. (See generally DE #13 ). "A party may amend its pleading once as a matter of course within: (A) 21 days after serving it, or (B) if the pleading is one to which a responsive pleading is required, 21 days after service of a responsive pleading or 21 days after service of a motion under Rule 12(b), (e), or (f), whichever is earlier." Fed. R. Civ. P. 15(a)(1). "In all other cases, a party may amend its pleading only with the opposing party's written consent or the court's leave." Fed. R. Civ. P. 15(a)(2). "The court should freely give leave when justice so requires." Id. In light of this lenient standard and the fact that no Defendant has yet appeared in this matter, Plaintiff's Motion is granted. Plaintiff must separately file in the court record and serve its Second Amended Complaint. See S.D. Fla. L.R. 15.1. The deadline to do so is June 8, 2021. Signed by Judge Donald M.
