PAPERLESS ORDER: The Court has carefully reviewed Defendants' Motion to Dismiss Count III of Plaintiff's Complaint [DE 7] and Plaintiff's Motion to Amend Complaint [DE 19]. In the Motion to Amend, Plaintiff is, in part, seeking to correct the alleged deficiencies in Count III of the Complaint that Defendants asserted in the Motion to Dismiss. Plaintiff is also seeking to add an additional plaintiff to the lawsuit. The Motion to Amend was filed prior to the deadline to add additional parties and amend pleadings as set forth in the Pretrial Scheduling Order and Order Referring Case to Mediation. [DE 11]. Additionally, according to the Certification of Rule 7.1(a)(3) Good Faith Conference included in the Motion to Amend, Defendants do not object to the relief sought. In light of the foregoing, the Court hereby DENIES AS MOOT #7 Defendants' Motion to Dismiss Count III of Plaintiff's Complaint without prejudice to re-file if necessary, and GRANTS #19 Plaintiff's Motion to Amend Complaint.
