July 21, 2021 Opinion or Order Filing 4 ORDER GRANTING IFP, ALLOWING TO PROCEED IN PART AND DISMISSING IN PART COMPLAINT PURSUANT TO 42 U.S.C. 1983. Plaintiff's Complaint [ECF No. #1 ] is ALLOWED TO PROCEED IN PART AND IS DISMISSED IN PART. Plaintiff shall be allowed to proceed with his excessive force claims against Sergeant Carter, Deputy Fountain, and Deputy Ford. Plaintiff's failure to intervene claim against Deputy Wately is dismissed without prejudice and with leave to amend. On or before August 21, 2021, Plaintiff shall file an amended complaint, labeled "Amended Complaint," that cures the factual deficiencies identified in this order. Plaintiff's Motion for Leave to Proceed In Forma Pauperis [ECF No. #3 ] is GRANTED. Plaintiff need not prepay a partial filing fee or costs for service of process in this case. Plaintiff owes the United States a debt of $350.00 which must be paid to the Clerk of the Court as funds become available. The jail/prison having custody of Plaintiff shall make payments from the prisoner's account to the Clerk of this Court each time the amount in the account exceeds $10.00 until the full filing fee of $350.00 is paid.
