Filing 4 PAPERLESS ORDER REQUIRING AMENDED COMPLAINT. In their Complaint (DE #1 ), Plaintiffs assert that this Court has subject matter jurisdiction over this case based on diversity but does not allege the facts necessary to plead diversity. Specifically, to properly plead the citizenship of a limited liability company ("LLC"), Plaintiffs must provide the citizenship of all the members of the LLC party. See Rolling Greens MHP, L.P. v. Comcast SCH Holdings, L.L.C., 374 F.3d 1020, 1022 (11th Cir. 2004). Although Plaintiff alleges that Defendant Oban Energies, LLC "was formed as a limited liability company under the laws of the State of Florida and has its principal place of business" in Palm Beach Gardens, Florida, Plaintiffs fail to identity each of Oban Energies, LLC's members and to allege their respective citizenship(s). Therefore, on or before June 18, 2021, Plaintiffs shall file an Amended Complaint that clearly states how many members Oban Energies, LLC has, identifies each member, and provides the proper citizenship of each member, and thus clearly establishes diversity jurisdiction. Plaintiffs are advised that failure to timely comply with this Order may result in dismissal of this action without prejudice. Signed by Judge Donald M. Middlebrooks on 6/15/2021. (kal) |
