Filing 16 PAPERLESS ORDER SETTING DEADLINE FOR FILING CLOSING DOCUMENTS AND EXTENDING DEADLINE TO RESPOND TO THE COMPLAINT. In light of the Parties' Notice of Settlement (DE #15 ), and the instructions set forth in the Pretrial Scheduling Order (DE #12 ), the Parties are ordered to file appropriate closing documents by September 20, 2021. Until closing documents are filed, all litigation deadlines will remain in effect. However, in view of the pending settlement, I will sua sponte extend the Defendants' deadline to respond to the Complaint from September 7, 2021 to September 20, 2021. Signed by Judge Donald M. Middlebrooks on 9/9/2021. (kal) |
Filing 15 NOTICE of Settlement by Audio Tec Designs, Inc., David Y. Holiday, Jennifer A. Holiday (Trueba, William) |
Filing 14 PAPERLESS ORDER granting in part #13 Unopposed Motion for Extension of Time. Defendants request a 21-day extension of time to respond to the Complaint on the grounds that counsel was "recently retained" and requires additional time "to prepare a proper response." (DE #13 at 2). Motions for extension of time must establish good cause supported by specific facts. Defendants' vague and generalized reasons for requiring an extension fall short of the good cause standard. Notwithstanding, because the Motion is unopposed, I will grant a brief one-week extension. Accordingly, Defendants shall respond to the Complaint on or before September September 7, 2021. Additionally, I note that Defendants' motion was docketed on the filing deadline. Going forward, counsel should ensure that requests for extension of time are made in advance of the deadline sought to be extended. Signed by Judge Donald M. Middlebrooks on 9/1/2021. (kal) |
