PAPERLESS ORDER denying without prejudice #3 Motion for Leave to Proceed In Forma Pauperis. A prisoner seeking to bring a civil action without prepayment of the court filing fee must file an affidavit and a certified copy of the trust fund account statement (or institutional equivalent) for the prisoner for the 6-month period immediately preceding the filing of the complaint...obtained from the appropriate official of each prison at which the prisoner is or was confined. 28 U.S.C. 1915(a)(2). Plaintiff has not filed such an account statement. By no later than November 26, 2021, Plaintiff shall either pay the court filing fee or file a renewed motion for leave to proceed in forma pauperis that is accompanied by the required account statement. Plaintiff's failure to pay the court filing fee or to renew his motion for leave to proceed in forma pauperis by November 26 will result in the dismissal without prejudice and closure of this case. Plaintiff's #4 Motion for Appointment of Counsel is denied. There is no right to appointed counsel in a civil case, and court-appointed counsel is not available for pro se plaintiffs in the Zantac MDL. Signed by Judge Robin L. Rosenberg on 10/28/2021. (sk01)
