Date Filed Document Text
March 15, 2022 Opinion or Order Filing 10 PAPERLESS ORDER SETTING DEADLINE TO FILE CLOSING DOCUMENTS. The Parties notified the Court that they have settled this matter (DE #9 ), and the Court congratulates them on reaching an amicable resolution of this case. The Parties shall file appropriate closing documents within 10 days, or no later than March 24, 2022. The Parties' request that they be excused from "fil[ing] any further responses, motions and/or pleadings" is denied. This Court does not view the Notice of Settlement as cause to stay ongoing litigation, and therefore until a voluntary dismissal is filed, the court will expect compliance with all pretrial deadlines. However, the record reflects that Defendant's response to the complaint was due on March 7, 2022. No response has been filed. In light of the pending settlement, I will extend that deadline only until March 24, 2022. No other deadlines are modified or extended as a result of this order. Signed by Judge Donald M. Middlebrooks on 3/15/2022. (kal)
March 14, 2022 Filing 9 NOTICE of Settlement by Howard Cohan (Sconzo, Gregory)
February 24, 2022 Opinion or Order Filing 8 PAPERLESS ORDER granting in part #7 Motion for Extension of Time. Defendant seeks an unopposed 14-day extension of the deadline to respond to the complaint. (DE #7 ). Based on the return of service, Defendant's response was due on February 23, 2022. (DE #6 ). In support, Defendant states that counsel was recently retained and is investigating the allegations in the complaint. Motions for extensions of time must set forth good cause supported by specific facts. Generalized references to counsel's retention and preparation do not provide the court with sufficient information to discern whether the good cause standard is met. Nevertheless, because the motion is unopposed, I will grant the requested relief in part. Accordingly, Defendant shall respond to the complaint on or by March 7, 2022. Signed by Judge Donald M. Middlebrooks on 2/24/2022. (kal)
