Filing 7 PAPERLESS ORDER denying without prejudice #3 Motion for Leave to Proceed In Forma Pauperis ("IFP"). Plaintiff has filed an IFP Motion [ECF No. #3 ]. For three reasons, the Court denies it without prejudice. First, the Court's Order of Instructions notifies Plaintiff that proceeding IFP "does not mean that Plaintiff will be allowed to pay nothing at all." Order of Instructions [ECF No. #5 ] at 3. In other words, even if Plaintiff proceeds IFP, he "will be billed for any outstanding costs and fees, including any expenses the U.S. Marshal's Service incurred on [his] behalf," regardless of whether he wins or loses in this case. Id. at 4. Denying without prejudice, therefore, provides Plaintiff one final opportunity to weigh the advantages and disadvantages of bringing this action. Second, the Court cannot predict whether Plaintiff will pursue this action in this case number since the Court has ordered Plaintiff to amend his complaint, see Order to Amend [ECF No. #6 ], so the question of whether IFP status should be granted is somewhat premature. Lastly, and more importantly, Plaintiff did not properly fill out the IFP form because he never responded to several questions. See generally IFP Motion. The IFP Motion, in short, is DENIED without prejudice. To renew his request to proceed IFP, Plaintiff must file a new IFP form with answers to all of the form's questions. For his convenience, the Court shall rely on Plaintiff's previously filed inmate account statement. See generally id. The Clerk's Office is INSTRUCTED to mail Plaintiff a copy of the long version of the IFP form. The Plaintiff, though, has until April 4, 2022 to file a complete version of that IFP form. Filing 6 ORDER TO AMEND. On or before April 1, 2022, the amended complaint must be docketed, signed under the penalty of perjury, and contain a short and plain statement of a claim for relief, a basis for federal jurisdiction, and a demand for judgment. Plaintiff shall be provided a form complaint. The Clerk's Office is INSTRUCTED to administratively close this case and to mail a copy of the prescribed form to Plaintiff.
