August 24, 2022 Opinion or Order Filing 22 PAPERLESS ORDER denying #21 the Parties' Joint Motion to Modify the Trial Date. The Parties jointly move to modify the trial date in this matter from April 10, 2023 to June 20, 2023, citing (1) their schedules over the Easter and Passover Holidays; and (2) a state court case of Defendants' counsel set for trial April 10-27, 2023. Neither establishes good cause for the relief requested. The trial date set by this Court encompasses a two-week period, and the second week of this period does not conflict with any of the aforementioned holidays. And, as to the state court trial, because many cases settle in advance of trial it is too soon to determine whether an actual conflict exists. In the event the conflict remains closer to the trial date, the Parties may renew their Motion at that time. Alternatively, if the Parties prefer, they may file a Motion to reset this matter for the trial period beginning March 27, 2023 to avoid any potential conflict. Signed by Judge Donald M. Middlebrooks on 8/24/2022. (jnk)

The Defendants collectively move for a six-day extension of time for Defendant City of Delray Beach, Florida and Defendant Terrence Moore to respond to the Complaint, so that their response deadline is the same as Defendant Hassan Hadjimiry's deadline. All Defendants are represented by the same counsel. In the interest of establishing a uniform response deadline, I find good cause to grant the Motion. Any motions to modify the existing trial date should be filed two (2) business days prior to the Scheduling Conference. Motions to modify the trial date must specifically state the basis for the request, including detailed factual support, and must provide a compelling reason. To log in through ZoomGov Meeting, use Meeting ID: 160 540 3826 and Passcode: 246129. All counsel shall appear by both audio and video.
