PAPERLESS ORDER. Plaintiff fails to properly allege that this Court has jurisdiction under 28 U.S.C. 1332. (DE #1 ). Plaintiff alleges that Defendant Grow, LLC is a citizen of Idaho because its principal place of business is in Idaho. But the principal place of business is a jurisdictional fact relevant to corporate defendants, and Plaintiff's Complaint alleges that Defendant is a limited liability company ("LLC"). An LLC is a citizen of any state of which a member of the company is a citizen. See Rolling Greens MHP, LP v. Comcast SCH Holdings LLC, 374 F.3d 1020, 1022 (11th Cir. 2004). Plaintiff fails to clarify whether the named individual Defendant -- a citizen of Idaho -- is the only member of Grow, LLC. Thus, the Court cannot determine whether complete diversity exists. See Cabalceta v. Standard Fruit Co., 883 F.2d 1553, 1557 (11th Cir. 1989) ("[T]he presence of at least one alien on both sides of an action destroys diversity.") Plaintiff is directed to cure this deficiency by filing an amended complaint on or before November 18, 2022.
