PAPERLESS ORDER denying #21 Motion for Default Judgment. As background, on February 8, 2023, Defendant Frontier Airlines removed this case to this Court. On February 16, Defendant Frontier Airlines filed a motion to dismiss the complaint. On March 1, the Plaintiff then moved for the entry of default against Defendant Frontier Airlines. The Court has reviewed the Motion and the Response #25 . Under Federal Rule of Civil Procedure 55, a defendant is in default when he or she fails to defend. A defendant may defend by moving to dismiss a complaint for failure to state a claim. Since Defendant Frontier Airlines has filed a motion to dismiss, Defendant Frontier Airlines is not in default.
