Filing 10 Joint Notice and Consent to Jurisdiction US Magistrate Judge signed by all parties . Filed by Cheryl Paul (Atkins, Sarah) |
Filing 9 PAPERLESS ORDER REQUIRING CLARIFICATION OF PLAINTIFF'S NOTICE OF CONSENT #8 : This matter is before the Court pursuant to the following: (1) the Court's Order Regarding Magistrate Judge Jurisdiction, Setting Social Security Case Procedures, and Briefing Schedule ("Order Regarding Jurisdiction") [DE 7]; and (2) Plaintiff's unilateral Notice of Consent to Exercise of Jurisdiction by a U.S. Magistrate Judge [DE 8] filed thereafter. In its Order Regarding Jurisdiction [DE 7], the Court noted that "if no party objects within fourteen (14) days from the date of this Order to Magistrate Judge jurisdiction, then consent to Magistrate Judge jurisdiction is presumed and deemed agreed to by the parties...." [DE 7 at 2]. The Court's review of Plaintiff's Notice of Consent [DE 8] shows that it was only signed by Plaintiff's counsel. The Court therefore requests clarification as to whether both Plaintiff and Defendant consent to Magistrate Judge jurisdiction. If all parties are in agreement, the parties may jointly sign and file a Notice of Consent to Magistrate Judge jurisdiction. If any party objects to Magistrate Judge jurisdiction, then a notice of objection should be promptly filed. Signed by Magistrate Judge William Matthewman on 10/5/2023. (cpe) |
