January 23, 2024 Opinion or Order Filing 23 PAPERLESS ORDER denying the Plaintiff's Motion to Remand #14 . The Plaintiff argues that the Defendant failed to remove this matter within the 30-day time period for removal, citing 28 U.S.C. section 1446(b)(3). The time limit begins to run when "it may first be ascertained" that the case is removable. Id. Here, the Defendant removed this matter within 30 days of receipt of evidence that the Defendant store manager was not present in the store at the time of the slip and fall in this case. That is timely. See WMS, LLC v. Allied Prop. & Cas. Co., 244 F. Supp. 3d 567, 572 (W.D. Tex. 2017). Given the store manager's absence, the Defendant has established the fraudulent joinder of the manager in this case for all of the reasons set forth in the Response. Signed by Judge Robin L.
