PAPERLESS ORDER denying #4 Motion to Appoint Counsel. A plaintiff has no constitutional right to counsel in a civil case, and the decision to appoint counsel is in the court's discretion. See Suggs v. United States, 199 F. App'x 804, 807 (11th Cir. 2006). Counsel should only be appointed in exceptional circumstances. See id. (citing Dean v. Barber, 951 F.2d 1210, 1216 (11th Cir. 1992)). The key is whether the pro se litigant needs help in presenting the essential merits of his position to the court. See id. The Court has no counsel it can appoint Plaintiff. Furthermore, despite his protestations and representations that he suffers from an undisclosed mental disability, Plaintiff has been able to file a complaint and two motions without assistance from counsel. Should the case not be dismissed upon screening of the Complaint, the Court will consider a request to refer the case to the Volunteer Lawyers program, where a lawyer might agree to accept the case.
