The Parties shall file appropriate closing documents by April 8, 2024. All pretrial deadlines remain in effect until closing documents are filed. I note that Trans Union's Answer is now past due. If no dismissal is filed by April 8, then I will permit Trans Union to respond to the Complaint by that date, however I caution the Defendant that this deadline will not be extended further absent extraordinary circumstances. Any motions to modify the existing trial date should be filed two (2) business days prior to the Scheduling Conference. Motions to modify the trial date must specifically state the basis for the request, including detailed factual support, and must provide a compelling reason. The parties are further advised that the Court is strongly disinclined to modify the trial date based upon the scheduling "tracks" contained within the Local Rules and/or based upon vague references to the complexities of the case. To log in through ZoomGov Meeting, use Meeting ID: 160 540 3826 and Passcode: 246129. All counsel shall appear by both audio and video. Signed by Magistrate Judge William Matthewman on 3/27/2024. March 7, 2024 Opinion or Order Filing 17 PAPERLESS ORDER granting in part #13 Motion for Extension of Time. Defendant OneMain Financial requests an additional thirty days to respond to Plaintiff's Complaint. In support, Defendant vaguely asserts that counsel was recently retained with no indication of when, and that additional time is required to prepare a meaningful response. Motions to extend deadlines must set forth good cause supported by specific facts. This motion does not sufficiently explain the need for the relief sought. Because it is unopposed, I will grant a short extension, but future motions that lack factual support will be denied. Defendant OneMain Financial shall respond to the Complaint on or by March 22, 2024. The extension of this deadline applies only to Defendant OneMain Financial. Signed by Judge Donald M. Middlebrooks on 3/7/2024. (kid)
March 7, 2024 Opinion or Order Filing 16 PAPERLESS ORDER granting in part #10 Defendant Trans Union LLC's Motion for Extension of Time. Defendant Trans Union LLC requests an additional thirty days to file its response to Plaintiff's Complaint. In support, Defendant represents that the Parties are actively engaged in case-resolution negotiations. In the interest of encouraging the early resolution of this case I will grant an extension, however Defendant does not set forth good cause for the requested month long delay. The Parties can, of course, continue to engage in settlement discussions while this case moves forward in litigation. Therefore, the motion is granted in part, and I will extend the deadline for Defendant Trans Union LLC to respond to the Complaint to March 22, 2024. This extension applies only to Defendant Trans Union LLC. Signed by Judge Donald M. Middlebrooks on 3/7/2024. (kid)
