April 18, 2024 Opinion or Order Filing 20 PAPERLESS ORDER denying #18 Motion to Continue Trial. Defendant requests to continue trial in this case, which is scheduled for the two-week period beginning November 4, 2024. "A continuance of any trial... will be granted only on exceptional circumstance[.]" Local Rule 7.6. In support, Defendant states the following: (1) that it has filed a motion to dismiss, (2) counsel has four other trials in different matters in May to October that could interfere with discovery, and (3) counsel has preplanned international travel from October 15 through 26. I do not find the filing of a motion to dismiss or a busy schedule to constitute grounds to continue. Although I might find that prepaid travel warrants a continuance in certain situations, Defense counsel's travels do not appear to conflict with the scheduled trial period. Therefore, I will deny the motion. Should the Parties later believe that they need additional time for discovery or other pretrial deadlines that the Magistrate sets, they should file an appropriate motion. Such motion will be granted if supported by good cause and specific facts, explaining any particular obstacles that, despite their diligence, prevent the Parties from litigating the matter under the current schedule.
