April 17, 2024 Opinion or Order Filing 13 ORDER CLOSING CASE. The Clerk of Court shall CLOSE this CASE and DENY all pending motions AS MOOT. Signed by Judge Donald M. Middlebrooks on 4/17/2024. See attached document for full details. (ebz)

April 8, 2024 Opinion or Order Filing 11 PAPERLESS ORDER SETTING DEADLINE TO FILE CLOSING DOCUMENTS. The Parties notified the Court that they have settled this matter (DE #10 ), and that they expect to submit appropriate dismissal papers within twenty days. Consistent with the instructions set forth in this Court's ADA Title III Scheduling Order (DE #5 at p.3), appropriate dismissal documents usually must be filed within ten (10) days; however, because this case was recently filed and resolved early, I will permit a brief extension of this timeframe. Accordingly, the Parties must ensure that appropriate closing documents are filed on or by April 25, 2024.The Parties are advised that the Notice of Settlement does not stay this litigation, and therefore, until closing documents are filed, the Court will expect compliance with all pretrial deadlines. However, in light of the pending settlement, the deadline for Defendant to respond to the Complaint is extended to April 25, 2024. Signed by Judge Donald M. Middlebrooks on 4/8/2024. (gm1)
April 5, 2024 Filing 10 NOTICE of Settlement (Joint) by HESSLER PAINT & ACE HARDWARE, CORP (Chotiner, Adam)
March 26, 2024 Opinion or Order Filing 9 PAPERLESS ORDER granting in part #8 Defendant's Motion for Extension of Time. Defendant requests an additional three weeks to respond to Plaintiff's Complaint. In support, Defendant vaguely asserts that counsel "was recently retained," with no indication of when, and that counsel is busy with other litigation matters. Motions for extensions of time must set forth good cause supported by specific facts. This motion does not sufficiently explain the need for the relief sought. Because it is unopposed, I will grant a short extension, but future motions that lack factual support will be denied. Defendant shall respond to the Complaint on or by April 9, 2024. Signed by Judge Donald M. Middlebrooks on 3/26/2024. (kid)
