PAPERLESS ORDER: Plaintiff, proceeding pro se, moves for appointment of the U.S. Marshal to effect service #6 . Under Fed. R. Civ. P. 4(c)(3), the Court may order service by the U.S. Marshal, but such appointment remains discretionary unless a plaintiff proceeds in forma pauperis or as a seaman. The record reflects that Plaintiff paid the filing fee rather than seeking to proceed in forma pauperis. (DE 5). The Court denies the Motion #6 without prejudice as Plaintiff has not sufficiently explained why the Court should exercise such discretion and order service by the US. Marshal. Plaintiff remains responsible for timely service in accordance with Fed. R. Civ. P. 4(m). The Complaint was filed on January 29, 2026, therefore, service must occur on or before April 29, 2026. Failure to timely serve may result in dismissal without prejudice.
