PAPERLESS ORDER denying #14 Motion to Strike #12 Answer to Complaint. It is well-settled that a company must be represented by counsel when litigating a claim and cannot appear pro se. See Palazzo v. Gulf Oil Corp., 764 F.2d 1381, 1385 (11th Cir. 1985). Defendant Van Ness Pharmacy LLC, is a limited liability company. The record indicates its #12 Answer was filed by Defendant Luc H. Yaya. Nothing in the record suggests that Luc H. Yaya is licensed to practice law. Therefore, this Court finds Defendants' #12 Answer is improper insofar as it is filed by Luc H. Yaya on behalf of Van Ness Pharmacy LLC. The question remains, however, whether striking the #12 Answer is proper. Federal Rule of Civil Procedure 11(a) requires that "[e]very pleading... be signed by at least one attorney of record" and that "[t]he court must strike an unsigned paper unless the omission is promptly corrected after being called to the attorney's or party's attention." The record does not show this matter was ever called to Van Ness Pharmacy LLC's attention prior to Plaintiff, Raymonda Kondos's filing the #14 Motion. This Court, therefore, finds it appropriate to give Van Ness Pharmacy LLC a reasonable time to file an Answer or Amended Answer signed by an attorney. Accordingly, Van Ness Pharmacy LLC is hereby permitted to file an Answer or Amended Answer signed by an attorney by May 13, 2026. Signed by Judge Ed Artau (mdn)
