If granted, the party calling the witness would be responsible for paying for and making arrangements for the video conferencing equipment. The Court finds that Plaintiff's request as currently stated, for all requisition and purchase orders, is overly broad and irrelevant, especially given that Plaintiff appears to have already received all documents related to TRO reimbursement requests. However, Rule 26(b)(1) provides that the scope of discovery is generally "any matter, not privileged, that is relevant to the claim or defense of any party..." Fed. R. Civ. P. 26(b)(1). Therefore, the Court finds that restricting the relevant time frame for Plaintiff's request from July 17, 2000 up to and including December 31, 2001 is enough of a limitation and specification to avoid the request from being overly broad. Accordingly, Defendant's motion is granted to the extent that the Court is modifying Plaintiff's subpoena duces tecum request to the period from July 17, 2000 up to and including December 31, 2001. Filing 74 EO :The Court, having reviewed Defendant Nancy Murphy's Motion to Quash or Modify Subpoena Duces Tecum, filed April 17, 2003, hereby informs the parties of its inclination to grant the motion and to uphold Defendant's Rule 26 relevancy objection. Specifically, the Court is inclined to find that Plaintiff's request for all requisition and purchase orders is overly broad and irrelevant, especially given that Plaintiff appears to have already received all documents relating to TRO reimbursement requests. Rule 26(b)(1) provides that the scope of discovery is generally "any matter, not privileged, that is relevant to the claim or defense of any party . . . ." Fed. R. Civ. P. 26(b)(1). The rule (which was amended in 2000) focuses party-controlled discovery in terms of claims and defenses. Whether information is discoverable depends on the specifics of the litigation. See Fed. R. Civ. P. 26(b)(1) advisory committee's note (2000) ("The Committee intends that the parties and the court focus on the actual claims and defenses . . . . information that could be used to impeach a likely witness, although not otherwise relevant to the claims or defenses, might be properly discoverable . . . The parties should appear at the May 22, 2003 hearing prepared to discuss the issue of relevance and/or to direct the Court to controlling case law that either supports or contradicts this matter.
