April 15, 2010 Filing 276 EO: re #274 On April 14, 2010, Plaintiffs filed a Motion for Attorney Fees. The same day, Plaintiffs filed an Ex Parte Motion to Shorten Time for Hearing Plaintiff's Motion for Attorney Fees. Plaintiffs seek an expedited ruling from the Court in light of the upcoming end to the legislative session on April 30, 2010. The Court DENIES the Ex Parte Motion. First, motions for attorneys' fees are non-hearing motions. Second, pursuant to Local Rule 54.3, briefing on the Motion for Attorney Fees will not be completed until at least May 26, 2010. Third, even if the Court ordered the parties to adhere to an expedited briefing schedule that would enable this Court to issue a decision before the close of the legislative session, which is April 29, 2010, http://www.capitol.hawaii.gov/site1/info/time/time.asp, said decision will be in the form of a Report of Special Master, which, as a recommendation, is not the final decision on the matter. Local Rule 53.2. Until the district court takes action on the Report, no "order" will be issued. At this late date, a mere 10 work days before the close of the legislative session, it would be impossible to modify a process that would ordinarily take a minimum of 77 days.
