The Appeal is DENIED as to the request to strike Paragraph 21. The Court ORDERS the parties to meet and confer regarding the applicability of 36 C.F.R. § 1230 .14(e). If the parties fail to agree upon a modified version of Paragraph 21 by March 8, 2012, this court will REMAND this matter to the magistrate judge for reconsideration in light of the authorities identified in this Order.
