ORDER GRANTING IN PART and DENYING IN PART Defendant The United States of America's Motion To Dismiss and GRANTING Plaintiff's Motion For Remand re 55 60 .On the basis of the foregoing, the Government's Motion to Dismiss, filed M ay 9, 2019 is HEREBY GRANTED IN PART AND DENIED IN PART. The Motion to Dismiss is GRANTED insofar as Plaintiff's claims for: 1) repayment of the balance of the Note and Mortgage; and 2) attorneys' fees and costs against the Substitute Res, are DISMISSED WITH PREJUDICE. The Motion to Dismiss is DENIED as to Plaintiff's claim for a deficiency judgment against the Kealohas, jointly and severally.Plaintiff's Motion for Remand, filed May 24, 2019, is HEREBY GRANTED as to P laintiff's remaining claim for a deficiency judgment against the Kealohas, and this case is REMANDED to the State of Hawai`i, First Circuit Court.
