Filing 8 EO: On September 5, 2019, Plaintiffs filed a Complaint and an application to proceed in forma pauperis ("IFP Application"). ECF Nos. #1 - #2 . On October 11, 2019, this court ordered Plaintiffs to show cause ("OSC") by November 12, 2019 why their Complaint should not be dismissed for lack of subject-matter jurisdiction and held their IFP Application in abeyance pending the filing of their Response to the OSC. ECF No. #4 . On October 31, 2019, Defendants filed a Motion to Dismiss the Complaint for lack of jurisdiction. ECF No. #5 .Defendants' Motion is premature. In fact, Defendants concede that they have not yet been served with the Complaint. Before this case may proceed, the court must first rule on the IFP Application; and if granted, screen the Complaint; and if the court determines that Plaintiffs have stated a claim, direct service of the Complaint. See 28 U.S.C. 1915(a)(1), (e)(2). Thus, Defendants' Motion to Dismiss, ECF No. #5 , is DENIED without prejudice to refiling if a screened Complaint is served on Defendants. (CHIEF JUDGE J.
