Filing 13 EO: On 10/31/19, Plaintiff's counsel sent an email to this Court's Courtroom Manager requesting an expedited discovery assistance conference pursuant to LR37.1(c). Under LR37.1(c) and FRCP 26(d), parties may not seek discovery, including expedited discovery assistance, until the parties have met and conferred. Nevertheless, FRCP 26(d)(1) provides an exception to this rule in that parties who have not met and conferred may conduct discovery if authorized by a court order. Requests for such an order are granted in rare circumstances. See Third World Media, LLC v. Hawaii Members, Civ. No. 11-536 DAE-RLP, 2011 WL 13136257, *1 (Oct. 6, 2011) (citations omitted). Early discovery is permitted when good cause has been established. Courts have found that "good cause" exists "'where the need for expedited discovery, in consideration of the administration of justice, outweighs the prejudice to the responding party.'" Venice PI, LLC v. Doe 1, Civ. No. 18- 00192 LEK-KSC, 2018 WL 6694834, at *3 (D. Haw. July 30, 2018). Here the Court does not find good cause for expedited discovery prior to the conference of the parties. Plaintiffs have not provided any information as to why they are unable to meet the requirements of FRCP 26(f)(1) prior to their request for expedited discovery. The record reflects that Plaintiffs recently served Defendants. (The Court points out that although proof of service for Ms. Naya has been filed (ECF No. 10), the attached summons is missing the Clerk of Court's signature). The rules require that the parties confer "as soon as practicable" and does not require them to wait until the deadline to hold a scheduling conference. FRCP 26(f)(1).
