Filing 10 EO: The Court has reviewed #3 Plaintiffs' Ex Parte Motion for Leave to Proceed Under Pseudonym ("Motion"). Plaintiffs request leave to proceed anonymously in this case so that their identities remain confidential. See ECF No. 3-1 at 2.The Court GRANTS Plaintiffs' request for leave to file their complaint as pseudonymous plaintiffs. However, to determine whether Plaintiffs may proceed anonymously beyond the pleadings stage, the Court must determine whether Plaintiffs' "need for anonymity outweighs prejudice to the opposing party and the public's interest in knowing the party's identity." Does I Thru XXIII v. Advanced Textile Corp., 214 F.3d 1058, 1068 (9th Cir. 2000). Because Plaintiffs' Motion was filed ex parte and concurrently with the Complaint, Defendants have not had an opportunity to respond. Accordingly, the Court DENIES Plaintiffs' request to proceed beyond the pleading stage anonymously at this time. After Defendants have appeared, Plaintiffs may file a renewed motion. Signed by MAGISTRATE JUDGE KENNETH J. MANSFIELD on 12/02/2019. (mansfield2) |
