Filing 4 EO: On December 23, 2019, Petitioner William Gilroy filed an "Emergency Plea: motion for habeas corpus" in the United States Court of Appeals for the Ninth Circuit as part of his appeal of this court's Order of Remand in Gilroy v. State of Hawaii, Civ. No. 19-00479 JMS-RT. See Doc. No. 20 , Gilroy v. State of Hawaii, No. 19-17210 (9th Cir.). The Ninth Circuit found that motion to be an "original petition for writ of habeas corpus" ("Petition"), and on January 23, 2020, transferred it to this court pursuant to Federal Rule of Appellate Procedure 22(a) (requiring that an original application for writ of habeas corpus "be transferred to the appropriate district court").Pursuant to the Ninth Circuit's instructions, this court directed the Clerk of Court to file the Petition in a new action. And because the Petition appears related to Gilroy, Civ. No. 19-00479 JMS-RT (see LR 40.2 of the Local Rules of Practice for the United States District Court for the District of Hawaii), this court directed the Clerk to directly assign the new action to this court.
