Filing 130 EO: On February 12, 2021, this Court entered an Order granting motions to remand and remanding actions to state circuit courts in Case Nos. 20-cv-163 and 20-cv-470. On the same day, but subsequent to the above-mentioned order, the Court received a letter from Defendants Chevron Corporation and Chevron U.S.A. Inc. (collectively, Chevron), asking that the Court instruct the clerk not to send certified copies of the order to the state circuit courts. Chevron asserts that it intends to file a motion to stay pending appeal and asks that such a motion be adjudicated before any direction is given by the Court regarding the service of its order on the state circuit courts. Upon review, the Court will temporarily stay its instruction for the clerk to mail certified copies of the above-mentioned order to the state circuit courts pending receipt of briefing and a decision on any motion to stay that may be filed. Chevron, and the other defendants in this case, may, collectively, file a motion to stay on or before February 19, 2021. No. 108, outlining the parties' competing positions regarding the propriety of a further stay pending Defendants' anticipated petition for certiorari to the United States Supreme Court in County of San Mateo, et al. v. Chevron Corp., et al. ("San Mateo"), Nos. 18-15499, 18-15502, 18-15503, and 18-16376 (9th Cir.), and City of Oakland, et al. v. B.P. PLC, et al. ("City of Oakland"), No. 18-16663 (9th Cir.), and having considered the issues in San Mateo and City of Oakland, the Court concludes that a stay of the proceedings in this case is no longer appropriate. There is not a strong likelihood of acceptance of certiorari or reversal; Defendants in this case will not be "irreparably injured absent a stay"; a further stay will, however, "substantially injure" Plaintiff by unnecessarily prolonging these proceedings for an indeterminate amount of time; and there is "always a public interest" in the "prompt" resolution of a dispute. Nken v. Holder, 556 U.S. 418, 434 (2009); see id. at 436. Accordingly, the Court LIFTS THE LITIGATION STAY imposed by Orders dated May 1, 2020 (Dkt. No. 80) and June 11, 2020 (Dkt. No. 93). Plaintiff CITY AND COUNTY OF HONOLULU may file a motion to remand, if any, by September 11, 2020, with any such motion not exceeding 60 pages. Defendants shall coordinate their efforts to file a single consolidated opposition brief (not exceeding 60 pages), which shall be filed no later than October 9, 2020. Plaintiff's reply brief (not to exceed 35 pages) shall be filed no later than October 30, 2020. A hearing on the motion, if needed, will be set following the completion of briefing. No. 24), the Court concludes that a stay of these proceedings is warranted, pending the resolution of two appeals argued before the Ninth Circuit Court of Appeals on February 5, 2020. See County of San Mateo, et al. v. Chevron Corp., et al., Nos. 18-15499, 18-15502, 18-15503, and 18-16376 (9th Cir.); City of Oakland, et al. v. B.P. PLC, et al., No. 18-16663 (9th Cir.). Collectively, these appeals are likely to address some, and possibly all, of the issues that the parties would present in the motion to remand that they anticipate filing, together with some of the issues that would undoubtedly be presented in various motions to dismiss that the parties also anticipate filing. Therefore, pending the Ninth Circuit's resolution of San Mateo and Oakland, all further proceedings and deadlines in this matter are hereby STAYED , including the filing of a motion to remand and any pleading or motion in response to the complaint.
