September 13, 2022 Filing 228 EO: Pursuant to the Ninth Circuit's #227 Order granting a limited remand to enable this Court to consider Defendant EC Paia, LLC's #199 Request Pursuant to Federal Rule of Civil Procedure 58(d) for Entry of Judgment in Favor of EC Paia LLC as to Plaintiffs' Claims ("Request"), the Court GRANTS the Request for the reasons stated in its #222 ORDER ISSUING INDICATIVE RULING ON MOTION FOR RELIEF FROM JUDGMENT UNDER RULE 60(A) and DIRECTS the Clerk to enter a corrected judgment stating as follows: On August 31, 2020, the Court issued an Order Granting in Part and Denying in Part Defendant's Motion for Partial Dismissal of the Complaint [ECF No. 26]. On November 13, 2020, the Court issued an Order Granting in Part and Denying in Part Defendant's Motion for Partial Dismissal of the First Amended Complaint [ECF No. 41]. On August 27, 2021, the Court issued an Order Granting in Part and Denying in Part Defendant's Motion for Summary Judgment [ECF No. 96]. Following a bench trial, the Court issued its Findings of Fact and Conclusions of Law in favor of Defendant on February 14, 2022 [ECF No. 185]. The Court therefore ORDERS, ADJUDGES, AND DECREES that JUDGMENT is entered in favor of Defendant and against Plaintiffs as to Plaintiffs' claims in this action.
