July 15, 2020 Filing 98 EO: Having preliminarily looked at the background of this case and at the pending motion to recuse Judge Watson, I invite Defendants to file optional responses of no more than 1000 words per party. For purposes of briefing relating to the recusal motion, Defendants American Bar Association and American Bar Association Legal Education Section are limited to a single response of no more than 1000 words. Any Defendant may opt not to file a separate response and may instead file a joint response with one or more other Defendants, but the combined total of all Defendants' responses may not exceed 6000 words. Defendants' responses are due no later than July 22, 2020, and should be served on Plaintiff by email or facsimile so as to allow him to respond within the time set in this minute order. By August 7, 2020, Plaintiff may, but need not, file a single reply memorandum of no more than 3000 words. He should submit that in hard copy. His deadline takes into account not only the possibility of multiple memoranda from Defendants but also the time needed for him to get the document to the Clerk of Court by mail. That is, he would have an earlier deadline if he were a pro se party living in Honolulu or a registered user of the electronic case filing system. I will decide the motion to recuse based on all memoranda and without oral argument. Parties should expect to meet their deadlines as set forth in this minute order and should not expect extensions. July 9, 2020 Filing 92 EO: On 07/02/2020, pro se Plaintiff Stephen Young filed a Motion for Early Discovery, Clarification of Issues, and Second Application Ex Parte Motion for Extension of Time to File a Response to ECF Nos. 26, 31, 34, 49, 58, and 68 ("Motion") (ECF No. 77). On 07/02/2020, the district court (1) denied Plaintiff's request for an extension of time to oppose five motions to dismiss; (2) denied Plaintiff's request for advisory rulings and clarification of defendants' motions; and (3) referred to this Court Plaintiff's request for early discovery in the Motion. Presently before this court is Plaintiff's request for early discovery in the Motion. As Plaintiff is proceeding pro se, this Court liberally construes his filing. Boag v. MacDougall, 454 U.S. 364, 365 (1982). However, Plaintiff's discovery request is overly broad, and Plaintiff fails to cite any legal authority that supports his discovery request. Further, under LR37.1, "[t]he court will not entertain any motion pursuant to Fed. R. Civ. P. 26 through 37... unless counsel have previously conferred, either in person or by telephone, concerning all disputed issues... in a good faith effort to limit the disputed issues and, if possible, eliminate the necessity for a motion..." This rule is applicable to pro se litigants. Plaintiff has not stated that the parties have conferred. If Plaintiff seeks discovery, he "may move for an order compelling disclosure or discovery[,]" but the "motion must include a certification that the movant has in good faith conferred or attempted to confer with the person or party failing to make disclosure or discovery in an effort to obtain it without court action." Fed. R. Civ. P. 37(a)(1). Plaintiff has not certified compliance with the rules. Accordingly, Plaintiff's request for early discovery is DENIED. Plaintiff is reminded that under LR81.1(a) "[p]ro se litigants shall abide by all local, federal, and other applicable rules and/or statutes." Failure to comply with the rules may result in sanctions, including dismissal of the case with prejudice. LR81.1(a). July 8, 2020 Filing 90 EO: On July 8, 2020, pro se Plaintiff Stephen Young sent via email to the Court's "Orders Email" a "Motion for Recusal" of the undersigned, a "Formal Request for Chief Justice J. Michael Seabright to hear the Plaintiff's Motion for Recusal," Young's declaration in support of his motion and request, and several other exhibits. Young's motion and the attachments have been docketed. Dkt. No. 88. Because Young's Motion for Recusal is expressly based, in part, on 28 U.S.C. Section 144, as supported by Young's declaration, and because Section 144 contemplates that, once a motion for recusal is filed, another judge will determine the matter, this Court refers the Motion for Recusal to Chief Judge J. Michael Seabright. Judge Seabright will decide which judge to assign to the Motion for Recusal. Pursuant to Section 144, this Court will "proceed no further" and thus take no new action on any pending matters in this case, until the Motion for Recusal is adjudicated. Pending that adjudication, all applicable deadlines remain in effect. If the Motion for Recusal is granted, another judge will be assigned to this case for all purposes. July 8, 2020 Filing 89 EO: On July 2, 2020, pro se Plaintiff Stephen Young sent an email to the Court's "Orders Email," which included the following attachments: (1) "Plaintiff's Motion for Early Discovery"; (2) "Memorandum in Support of Early Discovery"; (3) "Formal Requests to the ABA"; (4) "Declaration of Stephen Young"; (5) Dkt. Nos. 8, 9, 15, and 16 in Case No. 20-cv-35; (6) "Email Conversations Between the Plaintiff and Defendants (and Legal Counsel)"; and (7) a 694-page "Motion for Admission of Evidence Under Fed. R. Evid. 801 (d)(2)(B)." Six days later, on July 8, 2020, Young sent another email to the Court's "Orders Email," along with the following: (1) a "Motion for Recusal"; (2) Memorandum in Support of the Motion; (3) "Declaration of Stephen Young"; (4) Dkt. No. 22 in Case No. 20-cv-35; (5) the Docket Report for the instant action; (6) "Letter to Defendant Legal Counsel"; and (7) "Proposed Order for Recusal Motion."This is an inappropriate method for filing documents, whether pro se or not, particularly since these are not the only two occasions in which Young has done so. See Case No. 20-cv-35, Dkt. Nos. 20, 23. The Court's Orders Email is only for sending proposed orders that require the Court's review and approval/signature. See LR 10.5. Local Rule 10.3(g) further states: "No document may be filed by faxing or emailing it to the court unless the filing party has first obtained leave to do so. Leave will be subject to the court's discretion and will only be granted for good cause." Young has neither sought nor obtained leave to file via email. Moreover, as this Court has informed Young before, under Local Rule 81.1(f):Self-represented litigants must not informally communicate with the presiding judge or chambers staff by letter, telephone, or electronic means. Requests for action must be brought by motion subject to response by the opposing party. Documents sent directly to the presiding judge, other than confidential settlement conference statements, will be shared with all parties in the case. The court may, in its discretion, construe written ex parte requests as motions that shall be docketed and treated as such by all parties.LR 81.1(f). Notwithstanding that Young has again violated the Local Rules, the Court has docketed the attachments to Young's July 2, 2020 email on his behalf, Dkt. No. 77, and the Court has also docketed the attachments to Young's July 8, 2020 email, Dkt. No. 88. As a discretionary matter, however, in the future, any documents (other than proposed orders) sent to the Court's Orders Email will not be forwarded to the Clerk's Office for docketing, nor will the Court take any action on such submissions. If Young desires to communicate with the Court or make a request for action, he must file a motion with the Clerk's Office using the proper channels. July 2, 2020 Filing 80 EO: On June 19, 2020, in part based on Plaintiff's representation that he would file a singular response in opposition to five motions to dismiss filed by various defendants, this Court granted Plaintiff an extension of time until July 2, 2020 in which to do so. Dkt. No. 61. Now having used all of the extra time allotted by the Court, and never previously mentioning that two weeks was not sufficient, Plaintiff has reneged on his representation. Instead of filing his promised singular response in opposition, or even any opposition, Plaintiff has instead filed a motion seeking what he refers to as "early discovery," "clarification" of defendants' motions, advisory rulings on the law and rules applicable to defendants' motions, and a request for even more time to respond to defendants' motions. Dkt. No. 77. Plaintiff's request for more time is DENIED. Asking for more time on the afternoon of the deadline imposed by the Court, which includes Plaintiff's request for at least an additional week even were the Court to deny the request (Dkt. No. 77 at 2-3), is nothing short of gamesmanship and attempted bullying, which the Court will not countenance. Plaintiff's tactics are even more egregious given that, at no time during the course of this past two weeks, did he notify the Court of any difficulty with complying with the two additional weeks already afforded. Plaintiff was given a deadline and is expected to adhere to it, as would be the case with any party. Plaintiff's request for advisory rulings and clarification of defendants' motions is similarly DENIED. The Court will rule on defendants' motions when all parties have had an opportunity to brief the issues presented and not until then. Preliminary advisory rulings designed to assist one side in formulating its arguments are without basis or precedent, and, certainly, Plaintiff cites none. June 19, 2020 Filing 61 EO: On June 18, 2020, after the filing of four separate motions to dismiss by various defendants in this case, pro se plaintiff Stephen Young filed a motion for extension of time ("extension motion") to file a "single response" to those motions to dismiss. Dkt. No. 55. On the same day, but after the filing of the extension motion, a fifth motion to dismiss was filed in this case. Dkt. No. 58. Although it appears that the extension motion is opposed by some of the defendants, see Dkt. No. 55 at 5, given that five motions to dismiss have been filed in this case and plaintiff is proceeding pro se, an extension of time is clearly warranted. In the extension motion, though, plaintiff does not specifically request the length of extension he seeks. Having considered the matter, at present, the Court will allow plaintiff until July 2, 2020 to file his "single response" to the motions to dismiss, which is two weeks after the filing of the most recent motion to dismiss. The court also notes that, in the motion, plaintiff appears to indicate that his response, exhibits attached to the response, or both will contain a large number of pages. Id. at 4. Plaintiff is reminded that his "single response" must conform to the court's local rules, including Local Rule 7.4. Exceptions must be sought in advance and must be specific, with leave of court only sparingly given. The extension motion is GRANTED to the extent set forth herein. IT IS SO ORDERED.
