June 3, 2020 Filing 4 EO: On 05/18/2020 Plaintiff filed a document styled as a "Writ of Mandamus" [ECF #1 ]. Plaintiff was directed to pay the $350.00 civil filing fee or file an application to proceed in forma pauperis within twenty- eight days. [ECF #2 ]. On 06/01/2020 Plaintiff submitted a document titled "Writ of Habeas Corpus," with the original Writ of Mandamus attached and retitled as "Writ of Habeas Corpus" [ECF #3 ; 3-1]. The Court directed the Clerk to file the document in the present action as an amendment to Plaintiff's Writ of Mandamus. Plaintiff is DIRECTED to clarify his intent in filing these two documents. IF Plaintiff intended the Writ of Habeas Corpus [ECF #3 ] as an amended pleading in this action, superceding the original Writ of Mandamus [ECF #1 ], he must CLARIFY that in writing on or before 06/17/2020. In that event, Plaintiff is NOTIFIED that the civil filing fee for a petition for writ of habeas corpus is $5.00, not $350.00 . FURTHER, Plaintiff is DIRECTED to complete an amended petition on the court's form "Petition for Writ of Habeas Corpus Under 2241," and submit it on or before 06/17/2020. IF Plaintiff intended to proceed with his Writ of Mandamus in the present action, and to commence a Petition for Writ of Habeas Corpus Under 2241 in a separate action, he must CLARIFY this on or before 06/17/2020. In that event, the Clerk will open a new action and file the Writ of Habeas Corpus therein. Plaintiff IS DIRECTED TO submit an amended petition on the court's form "Petition for Writ of Habeas Corpus Under 2241" on or before 06/17/2020 to be filed in a new action. The Clerk is DIRECTED to send Plaintiff a form "Petition for Writ of Habeas Corpus Under 2241" so that he can comply with this Order. IT IS SO ORDERED. Show Cause Response due by 6/17/2020.
