| Filing 7 EO: The Court Denies Plaintiff Reneau C. Kennedy, Ed.D's Ex Parte Motion for Service of Verified Complaint Upon Defendant Vee Lee aka Voeuth Lay by Certified Mail, ECF No. 6 (Motion). Hawaii Revised Statutes sections 634-23 and 634-24 only permit service by certified mail if a plaintiff, after due diligence, cannot serve the defendant. Haw. Rev. Stat. 634-24. Although Plaintiffs process server has made three unsuccessful attempts to serve Defendant, the Motion does not indicate what those attempts involved, including any efforts the process server made to wait near Defendants home for Defendant. Upon this record, the Court cannot say that Plaintiff has exercised due diligence but remains unable to effect personal service. The Court denies the Motion accordingly. Pursuant to Rule 4(d) of the Federal Rules of Civil Procedure, Plaintiff may also offer the Defendant the option to waive service. See Fed. R. Civ. P. 4(d). |
