Filing 23 EO: In Civil No. 20-00419 JAO-KJM, In re Dubin, Mr. Kiuchi explained that he represents Mr. Dubin in this case and that Mr. Dubin represents the client Plaintiffs. Civil No. 20-00419, ECF No. 42 7. If that is so, Mr. Dubin's filings pertain exclusively to the client Plaintiffs and not himself, and Mr. Kiuchi's filings pertain exclusively to Mr. Dubin. The Court has repeatedly informed Messrs. Dubin and Kiuchi that if Mr. Kiuchi is counsel for Mr. Dubin, Mr. Dubin cannot act on his own behalf pursuant to Local Rule 83.5(a). Yet Mr. Kiuchi claims that "parties who are attorneys often appear as co-counsel in a case, but the Court can nevertheless restrict advocacy at hearings and trial to one counsel, which we fully respect. But such a limitation has never been applied to the filing of court papers." Id. Local Rule 83.5(a) expressly provides otherwise: "When a party is represented by an attorney, the party may not act on his or her own behalf in the action.... The court may strike any document filed by a party on his or her own behalf when the party is represented by counsel in the action." Plaintiffs may file joinders to the extent they are permitted by the Local Rules, but the Court will not accept a single filing as a consolidated filing on behalf of all Plaintiffs given that the plaintiff groups have different counsel. Filing 22 EO: Plaintiffs filed a #20 Second Ex Parte Motion to Continue the Deadline for Memorandum in Opposition to Defendant Lawyers Fund for Client Protection's Substantive Joinder, requesting an extension of the 7/26/21 opposition deadline to 7/30/21. Although the Motion has a 7/26/21 filed date, it was not entered until 7/27/21. Plaintiffs submitted a corrected #21 version on 7/28/21 in response to an advisory entry from the clerk's office concerning filing procedures. As a preliminary matter, the Motion was improperly filed on an ex parte basis. Local Rule 7.10 ("Any ex parte application must include a declaration that states why a stipulation or motion could not be submitted and sets forth the positions of other parties with respect to the request, if known." (emphasis added)). Regarding the merits of the request, the Motion is DENIED. Plaintiffs filed the Motion after the expiration of the 7/26/21 deadline when they were on notice of the deadline as of 7/6/21, having already obtained an extension of the original 7/12/21 deadline. ECF No. 18. It is unclear why Mr. Dubin filed this Motion when Mr. Kiuchi drafted it, but putting that aside, Mr. Kiuchi offers the same bases for an extension already presented in the first motion to continue -- he was on vacation until 7/9/21 and Mr. Dubin continues to experience health issues. They do not compel a further extension now. Plaintiffs were aware of the content of Defendants' motion to dismiss and substantive joinder since 6/17/21, and cannot feign surprise or legitimately claim they were unaware of the complexity until recently. Even accepting that excuse, it does not explain why Plaintiffs failed to request another extension sufficiently in advance of the 7/26/21 deadline. Instead, Plaintiffs seek relief that would cut significantly into Defendants' time to draft their replies (due on 8/2/21, giving them one business day) and limit the Court's ability to adequately prepare for the 8/18/21 hearing. The only issue more comprehensively briefed in the joinder than the motion to dismiss is Younger abstention. Because Plaintiffs addressed Younger in their opposition to the motion to dismiss, any further arguments in a separate opposition to the joinder would be duplicative. Defendants invoke abstention as an alternative to dismissal. Should the Court reach abstention and require additional information from Plaintiffs, it will request supplemental briefing. Messrs. Kiuchi and Dubin have elected to proceed as co-counsel for Plaintiffs. The Court will not countenance a tag-team effort whereby Mr. Kiuchi claims he cannot effectively complete work on Plaintiffs' behalf because only Mr. Dubin has the knowledge to prepare an opposition to the joinder. As co-counsel, they are equally responsible for representing Plaintiffs and meeting deadlines. More importantly, as the Court already explained to Messrs. Kiuchi and Dubin in a different case, if Mr. Kiuchi is representing Mr. Dubin, Mr. Dubin may not act on his own behalf. Local Rule 83.5(a). Finally, the Court is troubled that although Mr. Dubin represents the client Plaintiffs in this case, his present ability to effectively represent them may be impaired, based on the justifications underlying his repeated requests for extensions and continuances in this case and his reciprocal discipline proceedings.
