September 2, 2021 Opinion or Order Filing 44 EO: On August 31, 2021, Plaintiff filed a #42 Motion to Amend and/or Supplement Claim for Relief ("Motion"). The Court has reviewed the Motion and notes that it does not comply with the Local Rules. As the Court previously noted in its July 28, 2021 Entering Order, although Plaintiff is proceeding pro se, he is required to "abide by all local, federal, and other applicable rules and/or statutes." LR81.1(a). Local Rule 10.4 states, in part: "A motion... to amend a pleading must indicate in every respect how the proposed amended pleading differs from the pleading which it amends, by striking through the text to be deleted and underlining the text to be added." Because the Motion does not include a proposed amended pleading, the Court is unable to properly assess Plaintiff's request for leave to file an amended pleading. Accordingly, the Court DENIES the Motion. IT IS SO ORDERED. Signed by MAGISTRATE JUDGE KENNETH J. MANSFIELD on 09/02/2021. (mansfield3)COURTS CERTIFICATE of Service - Plaintiff was sent a Notice of Electronic Filing to his email address on record.

That same day, Plaintiff filed a #15 First Amended Complaint (Second Addendum) without leave of court. For the same reasons set forth in the 07/28/2021 EO, the Court STRIKES the #15 First Amended Complaint (Second Addendum). IT IS SO ORDERED.(MAGISTRATE JUDGE KENNETH J. MANSFIELD)(mansfield3)COURTS CERTIFICATE of Service - Plaintiff was sent a Notice of Electronic Filing to his email address on record. Modified on 9/2/2021 (mansfield2).

August 13, 2021 Filing 31 EO: The Court DENIES pro se Plaintiff Joshua James Medeiros's ("Medeiros") #23 Motion to Amend Complaint. Medeiros characterizes his case as a class action lawsuit and asserts that "Plaintiff will motion this court for Class-Action as soon as practible [sic]." ECF No. 23 at 5. "[A] plaintiff proceeding pro se may not pursue claims on behalf of others." McZeal v. JPMorgan Chase Bank, N.A., 735 F. App'x 913, 916 (9th Cir. 2018). Moreover, Federal Rule of Civil Procedure 23 requires a court that certifies a class to appoint class counsel. Fed. R. Civ. Pro. 23(g). The Court concludes that Medeiros's request to amend his complaint to include class action allegations would be futile since, as Medeiros intends to proceed pro se, he cannot fulfill the class action requirement to have class counsel. August 10, 2021 Opinion or Order Filing 28 EO: On August 5, 2021, Plaintiff filed a #27 Motion to Participate in Electronic Filing ("Motion"). The Court notes that Plaintiff left critical portions of the form blank, as Plaintiff did not indicate that he meets any of the technical requirements for e-filing. The Court thus DENIES the Motion. July 28, 2021 Filing 17 EO: On 07/25/2021, Plaintiff filed #11 a First Amended Complaint and a #14 First Amended Complaint (Addendum). A party may amend its pleading once as a matter of course. Federal Rule of Civil Procedure ("FRCP") 15(a)(1). All subsequent amendments require the opposing party's written consent or the court's leave. FRCP 15(a)(2).
