Because Plaintiff is a pro se litigant, the Court liberally construes the Letter as a motion for reconsideration of this Court's [ECF 18 ] 11/18/21 Entering Order ("Letter Requesting Reconsideration"). In this Motion, Plaintiff again requests the appointment of counsel for others when this case is not a class action suit. Plaintiff does not provide any argument or legal authority to show that any of the grounds for reconsideration apply in this case. Instead, Plaintiff explains that he is unable to cite to legal authority due to his apprehension of using public law libraries due to Covid-19. However, Plaintiff has brought this litigation and is required to "proceed with diligence to take all steps necessary to bring [this] action to readiness for trial." LR16.1. Thus, Plaintiff's arguments do not merit reconsideration. The [ECF #16 ] Motion for Reconsideration of Order Denying Motion for Urgent Medical Care is DENIED. In this Motion, Plaintiff argues that the Court made a factual error when it stated, [ECF 14 ] "[t]o the extent the Motion for Urgent Medical Care seeks an order directing Defendants to provide any care, urgent or otherwise, such a request is wholly premature and unsupported at this stage of the proceedings." Plaintiff argues that [ECF #16 ] "in his motion [he] never asks the Defendants for medical care." However, in the Motion for Urgent Medical Care, Plaintiff states: [ECF #12 ] "Plaintiff asks for Kaiser Foundation Health Plan, Inc. and Medicare's help in finding and especially negotiating a fair price, which is nearly impossible for an insured individual; but doesn't hold out much hope." Plaintiff's request in the Motion for Urgent Medical Care is far from clear, but was construed as being a request for care particularly since Plaintiff requests the negotiation of a fair price. However, even if it were correct that the Court made a factual error and Plaintiff is not seeking medical care from the defendants, such error does not constitute a manifest error of law or fact. Plaintiff's Motion for Reconsideration of Order Denying Motion for Urgent Medical Care is wholly inappropriate given that Plaintiff has not yet served the Defendants.The [ECF #17 ] Motion for Reconsideration of Order Denying Motion Compelling Discovery is DENIED. In this Motion, Plaintiff again argues that he seeks discovery from defendants, but still has not served them. Any party, including Plaintiff, may not seek discovery before the parties have conferred as required by Rule 26(f). See Fed. R. Civ. P. 26(d)(1). Plaintiff has not shown that the parties have conferred as required by this rule. Thus far, Plaintiff has not complied with many of the applicable rules and has not followed the Court's [ECF 14 ] 11/3/21 Entering Order. Plaintiff is cautioned that all parties are obligated to follow the applicable rules, statutes, and court orders. See LR81.1(a). Failure to do so may result in sanctions, including but not limited to a fine or dismissal of this case with prejudice. See id.; LR11.1. November 3, 2021 Opinion or Order Filing 14 EO: On 11/1/21, Plaintiff pro se Brian Edmund Stack ("Plaintiff") initiated this action with the filing of the following documents:1. [ECF #1 ] Complaint for a Civil Case ("Complaint");2. [ECF #11 ] Notice of Motion for Legal Representation ("Motion to Appoint Counsel");3. [ECF #12 ] Notice of Motion for Urgent Medical Care; and4. [ECF #13 ] Notice of Motion for Kaiser Permanente Medicare Submissions ("Motion Compelling Discovery").Neither the Complaint or summons have been served and no defendant has appeared. Despite this, Plaintiff filed [ECF #11 , #12 , & #13 ] three documents which the Court construes as separate motions (collectively "Motions") despite each being entitled a "notice of motion." The Court elects to decide these Motions without a hearing. LR7.1(c). As explained below, the Court DENIES Plaintiff's Motions. The [ECF #11 ] Motion to Appoint Counsel is DENIED. Plaintiff requests the Court appoint legal counsel to represent 22 million other American Medicare Advantage members whom he claims have been "stripped and victimized of their right to endoscopic spinal surgery by the Stack Exception[.]" ECF No. 11 at PageID #: 234. Plaintiff is proceeding pro se in this action and specifically acknowledges he "can only represent himself." Id. This is not a class action lawsuit. Nor can a self-represented plaintiff request a Court appoint counsel for anyone other than himself. Finally, Plaintiff offers no legal authority to support his request.The [ECF #12 ] Motion for Urgent Medical Care is DENIED. Plaintiff contends he "is desperate for endoscopic spinal surgery[.]" ECF No. 12 at PageID #: 237. To the extent the Motion for Urgent Medical Care seeks an order directing Defendants to provide any care, urgent or otherwise, such a request is wholly premature and unsupported at this stage of the proceedings. Plaintiff has not served the Complaint. No defendant has appeared. The Court has not decided any of Plaintiff's claims nor granted judgment in his favor. The [ECF #13 ] Motion Compelling Discovery is DENIED. Plaintiff states that he "has written on numerous occasions requesting Kaiser Foundation HP, Inc.'s Medical Submission, and none have been forthcoming. Would the court please order Kaiser Foundation HP, Inc. to turn over to Plaintiff just their Medicare Submissions in this case." [ECF #13 ]. Again, the Complaint remains unserved and no defendant, including "Kaiser Foundation HP, Inc." has appeared. Plaintiff is not authorized to yet engage in discovery of any kind at this juncture. "A party may not seek discovery from any source before the parties have conferred as required by Rule 26(f), except in a proceeding exempted from initial disclosure under Rule 26(a)((1)(B), or when authorized by these rules, by stipulation, or by court order."
