Filing 6 EO: On January 24, 2022, Defendants Ohana Military Communities, LLC and Hunt MH Property Management, LLC filed a Notice of Removal to remove the case numbered 1CCV-21-0001618 in the Circuit Court of the First Circuit, State of Hawaii to the United States District Court for the District of Hawaii. The case was assigned to United States District Judge Leslie E. Kobayashi and received case number 22-cv-00037 LEK-WRP. Later on the same day, Defendants Island Palm Communities, LLC and Hickam Communities, LLC filed their own Notice of Removal of the case numbered 1CCV-21-0001618. The filing contained an incorrect state court case number when it was entered into the CM/ECF system. The state court case being removed, attached to the Notice of Removal, was in fact 1CCV-21-0001618. This removal action was assigned to Judge Helen Gillmor and received case number 22-cv-00039 HG-RT. As both Notices of Removal concern the same underlying state court case, numbered 1CCV-21-0001618 in the Circuit Court of the First Circuit, State of Hawaii, there is only one case before the Hawaii Federal District Court. The case numbered 22-cv-00039 HG-RT is duplicative of the case first assigned to Judge Kobayashi, numbered 22-cv-00037 LEK-WRP. The Clerk of Court is directed to TRANSFER and CONSOLIDATE all filings in 22-cv-00039 HG-RT into 22-cv-00037 LEK-WRP.The case numbered 22-cv-00039 HG-RT is CLOSED. (SENIOR JUDGE HELEN GILLMOR)(rls) |
