April 26, 2022 Filing 17 EO: Based upon its review of the supplemental declarations in support of the Motion for Pro Hac Vice on behalf of Dawn McCraw, see ECF No. 16, the Court cannot yet determine whether Ms. McCraw should be permitted to again appear pro hac vice in this matter in light of Local Rule 83.1(c)(2)(A), which precludes pro hac vice admission if "the attorney is regularly engaged in business, professional, or law-related activities in Hawaii." In light of the May 11, 2022 hearing on the Order to Show Cause issued in Stephens v. Experian Information Solutions, Inc., (1:22-cv-00046-SOM-KJM) related to Ms. McCraw's pro hac vice admission in that matter, which will address the same issues the Court has raised in this matter, the Court will reserve ruling on Ms. McCraw's Motion for Pro Hac Vice until after the conclusion of that hearing and, if necessary, set a hearing on Ms. McCraw's Motion at that time. April 19, 2022 Filing 15 EO: On April 18, 2022, counsel for Plaintiff filed a #14 Motion for Pro Hac Vice on behalf of Dawn McCraw. However, the Declaration of Dawn McCraw is not signed. In addition, the declaration indicates that Ms. McCraw has not made a motion to appear pro hac vice in a case or proceeding in the District of Hawaii within the preceding year. However, from the Court's review, Ms. McCraw has been granted pro hac vice status in a number of proceedings in the past year, including in two cases this month. By no later than April 25, 2022, Ms. McCraw shall file a supplemental declaration addressing these deficiencies, including a complete response to whether she has "within the year preceding the current application made any pro hac vice application in this court, and if so, the case name and number of each matter wherein the attorney made the application, the date of the application, and whether or not the application was granted[.]" LR 83.1(c)(2)(B)(v). The declaration must also address whether she accurately disclosed her prior pro hac vice applications in compliance with Local Rule 83.1(c)(2)(B)(v) in the other cases where those applications have already been granted and, if not, an explanation for any lack of disclosure. Finally, the declaration must also explain why Ms. McCraw should be permitted to again appear pro hac vice, notwithstanding Local Rule 83.1(c)(2)(A), which precludes pro hac vice admission if "the attorney is regularly engaged in business, professional, or law-related activities in Hawaii."
