Filing 7 EO: On April 14, 2022, Plaintiff Michael Pectol filed the Complaint in this matter along with an Application to Proceed Without Paying Fees or Costs ("IFP Application"). See ECF Nos. #1 and #2 . The court screened the Complaint and dismissed it for failing to plead a viable claim supported by factual allegations. The court denied the IFP Application as moot. See ECF No. #4 . The court gave Plaintiff leave to file an Amended Complaint and a new IFP Application (or to pay the applicable filing fee) no later than May 13, 2022. Id. This means that Plaintiff has permission to file a new complaint, called an "Amended Complaint." The court provided Plaintiff with guidance with respect to the requirements of a Complaint. Id. Shortly after the court filed its order, Plaintiff filed a "Motion for: Courtroom hearing/Expedited" and a notice. See ECF No. #5 and #6 . To the extent Plaintiff requests a hearing, that motion is denied, as there is currently no Complaint before this court that would support any relief. It appears from Plaintiff's motion that he misunderstands the process before this court. Plaintiff has come to this court asking for relief. However, to meet his burden to demonstrate entitlement to any relief, Plaintiff cannot simply reference other unidentified case files before other courts and claim discrimination. It is Plaintiff's burden to provide this court with any documents Plaintiff wishes this court to review and a clear explanation as to why he is entitled to relief. Additionally, when ruling on motions, judges in this court do not provide parties with identification nor proof of reviewing the record. This court will take no action on this case until an Amended Complaint is filed.
