Filing 40 AMENDED EO: On September 23, 2022, pro se Defendant Denise Jamey Jackson ("Defendant Jackson") filed a 33 Motion to Answer to Strike, in which Defendant Jackson requests an extension of the deadline to respond to 20 Plaintiff's Second Motion to Strike. Defendant Jackson asks the Court to extend the deadline until after ruling on Defendant Jackson's motion for appointment of counsel. Filing 24 EO: On September 15, 2022, Defendant Jamey Denise Jackson ("Defendant Jackson") filed a #23 Motion to Proceed In Forma Pauperis and for the Appointment of Counsel for Defendant Jamey Denise Jackson ("Motion"). Defendant Jackson asks the Court to appoint her pro bono counsel.There is no constitutional right to counsel in a civil case. See Lassiter v. Dept of Soc. Serv., 452 U.S. 18, 25 (1981). Pursuant to 28 U.S.C. 1915(e)(1), a district court has discretion to request an attorney to represent an indigent litigant in "exceptional circumstances." See Terrell v. Brewer, 935 F.2d 1015, 1017 (9th Cir. 1991); see also Jenkins v. Perry, 592 Fed. Appx. 597, 598 (9th Cir. 2015) (reviewing district court's denial of appointment of counsel for abuse of discretion). After carefully reviewing the record in this case, the Court finds that exceptional circumstances do not exist at this time to warrant appointment of pro bono counsel to Defendant Jackson under 1915(e)(1). There is nothing in the record demonstrating that Defendant Jackson is likely to prevail on the merits. In addition, Defendant Jackson's filings indicate that she is able to articulate her arguments and defenses at this early stage in the litigation. The Court thus DENIES the Motion. IT IS SO ORDERED.
