| Filing 12 EO: Plaintiff filed the #8 Ex-Parte Application for Leave to Serve a Third-Party Subpoena Prior to a Rule 26(f) Conference and #9 Ex-Parte Application for the Continuance of the Telephonic Case Management Conference (collectively, the "Applications"). Although Plaintiff filed the Applications ex parte, the Court finds that Plaintiff had no proper basis to do so. Plaintiff explains that its counsel could not contact and confer with defendant regarding the substance of the Applications before filing because the defendant's true identity is not yet known. The Court finds, however, that Plaintiff's explanation does not amount to good cause to restrict the Applications from public viewing. The Court thus ORDERS Plaintiff to cease filing applications and motions on an ex parte basis without proper justification.
